By accessing or using AI Chatbot services operated by Omni Hosting ("Company", "we", "us"), you agree to comply with and be bound by these Terms of Service. If you do not agree, please do not use our services.

2. Services Description

Omni Hosting provides AI-powered chatbot SaaS (Software as a Service) solutions including:

• AI chatbot deployment on client websites
• Lead capture and management tools
• Analytics and conversation tracking
• Knowledge base management
• WordPress and website integration plugins

3. Account Registration

To use our services, you must create an account and provide accurate information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Ensuring your email address is valid and verified

4. Acceptable Use

You agree NOT to use our services to:

• Violate any applicable laws or regulations
• Send spam, unsolicited messages, or misleading content
• Collect user data without proper consent or disclosure
• Distribute malware, viruses, or harmful code
• Impersonate any person or entity
• Engage in fraudulent or deceptive practices
• Violate intellectual property rights of others
• Use our AI for generating illegal, hateful, or harmful content

5. Token Usage & Fair Use

Our services operate on a token-based system. Each plan includes a specified token limit. You agree that:

• Tokens are consumed per AI interaction and cannot be rolled over
• Unused tokens expire at the end of your plan period
• Excessive or automated API usage that degrades service quality is prohibited
• We reserve the right to throttle usage in cases of abuse

Paid plans are subject to the following terms:

• All prices are in Indian Rupees (INR) unless stated otherwise
• GST (18%) will be applied to all invoices as per Indian tax laws
• Payments are processed through secure payment gateways
• Subscriptions auto-renew unless cancelled before the renewal date
• We reserve the right to change pricing with 30 days prior notice

7. Data & Privacy

Your use of our services is also governed by our Privacy Policy. You acknowledge that:

• Visitor data collected through your chatbot is your responsibility
• You must comply with the Digital Personal Data Protection Act, 2023 (DPDP Act), Information Technology Act, 2000, and GDPR if applicable
• You must have a privacy policy on your website informing users of data collection
• We process your data as a data processor on your behalf
• Conversation data may be transmitted to third-party AI providers (including but not limited to Google Gemini, OpenAI, Anthropic, Groq, or other AI models) solely for generating AI responses
• We do not use your chatbot conversations to train public AI models

8. Knowledge Base & Customer Content

Documents, webpages, PDFs, DOCX files, or any other files uploaded to the Knowledge Base remain the sole property of the customer. Omni Hosting processes such content solely for providing the requested AI chatbot services and does not claim ownership over customer content. We will not use, share, or disclose your uploaded content for any purpose other than delivering the agreed services.

9. Intellectual Property

All content, features, and functionality of our platform — including software, design, logos, and documentation — are owned by Omni Hosting and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our written consent.

10. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service. We are not liable for:

• Temporary service interruptions for maintenance
• Disruptions caused by third-party AI providers (Google Gemini)
• Force majeure events beyond our control
• Data loss due to technical failures (we recommend regular backups)

We reserve the right to suspend or terminate your account without notice if you:

• Violate these Terms of Service
• Engage in fraudulent activity
• Fail to pay for services
• Use the service in a way that harms other users or our infrastructure
• Engage in chargeback abuse or repeated misuse of the refund policy

Termination decisions will be made in accordance with applicable laws. Where permitted, we may terminate accounts with or without prior notice depending on the severity of the violation.

These Terms shall be governed by and construed in accordance with the laws of India, including the Digital Personal Data Protection Act, 2023 (DPDP Act), Information Technology Act, 2000, and Consumer Protection Act, 2019. Any disputes shall be subject to the exclusive jurisdiction of courts in Patna, Bihar, India. We encourage resolving disputes amicably through our support team first.

Omni Hosting shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to:

• Internet outages, ISP disruptions, or network failures
• Cloud infrastructure or data center failures
• Natural disasters, floods, earthquakes, or pandemics
• Cyber attacks, DDoS attacks, or security incidents
• Government actions, regulatory changes, or legal orders
• Third-party AI provider outages (including but not limited to Google Gemini, OpenAI, Anthropic, Groq, or other AI models)

We may update these Terms from time to time. We will notify you via email or in-app notification of significant changes. Continued use of our services after changes constitutes acceptance of the new Terms.
